Board Approves Reduced-Flow Well Variance
Board of Health · Meeting of October 5, 2026
Tyngsborough Board of Health clears a stalled $475,000 home sale by approving a below-standard well. The board voted 3-0 to grant buyer Elliot Morales a variance for a well yielding four gallons per minute, short of the town's five-gallon-per-minute minimum, conditioned on two 120-gallon storage tanks and a deed restriction. Broker Paul Rowe of Laird Realty Partners said delays had already cost his client roughly $95,000 in added interest as rates climbed toward 7 percent.
Well contractor Derek testified the well ran clear at "four gallons per minute continuously" for 14 hours but turned silty at higher rates. A pending "gross alpha" water test could still trigger mandatory filtration. Separately, the board tabled a Select Board-linked push to waive the $26 monthly smart-meter opt-out fee and heard that Health Director Kerri Oun is departing after 16 years.
