Ayer Zoning Board of Appeals continues a home-landscaping special permit hearing to September 28 pending an aquifer buffer review. The applicant, running a landscaping business on a Wilton Road property owned by his uncle, testified he has operated there eight years "with not one problem, not one complaint, not one noise complaint." Member John Ellis flagged that the applicant, as a non-owner, cannot legally hold the special permit under the town's bylaw as written. Members also questioned whether his two unrelated employees exceed the one-non-resident-worker cap and ordered a conservation agent review of the property's distance to Bennett's Brook, which feeds Spectacle Pond, a town water source.
Separately, the board scheduled a September 28 informational meeting on developer-proposed changes to a pending Chapter 40B project, after town counsel found the revisions "insubstantial" under the state's 20-day review deadline. The board also approved its August 19 meeting minutes unanimously.
