Concord Light Board votes to rebut open meeting law complaint

Concord Light Board votes 5-0 to rebut an open meeting law complaint over closed-door energy talks. Town Counsel Meena Makarius told the board a resident's complaint, dated Aug. 18, was filed more than 30 days after the July 8 and July 14 executive sessions it challenges, making it untimely, but the board addressed the merits anyway. Makarius said the sessions properly fell under the energy-procurement exemption, not the real estate exemption the complainant argued for, since the board was discussing power purchase agreement pricing, not the middle school roof itself.
Member Chris Schaffner said the complaint's "concealment of single source procurement" claim was "a very serious concern," countering that the pricing came through Power Options, a state-licensed energy broker running a public bidding process. The board voted 5-0 to send the response to the resident and the attorney general's office.
