Wayland Conservation Commission Continues Rice Road Wetland Dispute, Awaits DEP Drought Guidance

Wayland Conservation Commission continues contested Rice Road wetland delineation for the third time, pending state guidance on drought-era stream delineation. The commission voted unanimously at its September 9 meeting to continue the abbreviated notice of resource area delineation for 26 Rice Road (DEP 322-1066) to September 30, after peer reviewer Dave Burke told commissioners he could not find continuous hydric soils linking the upstream pool to a culvert under Thompson Road and concluded the channel does not meet the regulatory definition of a protectable intermittent stream. Conservation Administrator Linda Hansen said the department is awaiting a response from DEP on how to treat intermittent stream delineations conducted during an extended drought, and separately noted that outstanding property taxes bar the commission from issuing any permit.
Property owner Adam Stack told the board, "I've done what you've asked so many times with different scientists and it's still not enough." Chair Sean Fair said the case is further complicated by an enforcement dimension: construction done since 2018 may itself have altered the site hydrology under review. The commission also voted unanimously to issue a conditional stormwater permit for 15 Pequot Road pending Board of Health approval, issued a certificate of compliance for 149 Woodridge Road, approved a septic replacement determination for 15 Wheelock Road, and deferred action on a proposed electric bear fence around beehives at the Cow Common apiary, asking beekeeper David Bechtel to submit safety certifications before the next meeting.
