Sherborn Board of Health grants C&L Frosty variance, clears path to spring opening

Sherborn Board of Health approves C&L Frosty's 2026 permit with a variance to operate without a completed ADA bathroom through the end of May. The board voted 4-0-1 on February 11, with Member Rebecca Hunnewell, M.D., abstaining after proposing a portable toilet as an alternative that would have eliminated the need for a variance altogether. Building owner Elias Tembelopoulos presented a revised plan placing the new ADA-compliant bathroom inside the dining room rather than outside at the rear of the building, reducing seating from 20 to roughly 14 to 16.

The applicants are required to send project status updates to Health Administrator Sarah Lapin before the board's first meetings in March, April, and May. The board also voted unanimously to advance a proposed permit fee schedule — built on a calculated hourly rate of $80.85 for environmental health work — to a public hearing at its March 4 meeting, where it intends to enact the changes; the most significant single increase would raise the seasonal food service establishment permit from $50 to $250.
