Tyngsborough Planning Board Continues Kendall Road Tavern Permit to March 19
TYNGSBOROUGH — March 5, 2026 — Tyngsborough Planning Board continued a restaurant and tavern special permit to March 19 and debated a long-overdue overhaul of the town's subdivision regulations. Attorney Pete Nicosia, representing applicant Frank Glavin and the entity Tyngsborough Tap and Tavern, Inc., presented a special permit and site plan review application to construct a 3,505-square-foot addition with a 1,660-square-foot outdoor patio at 16, 20, and zero Kendall Road — a project first approved before the COVID-19 pandemic shut it down. Board members said they wanted peer review engineer David Nader of TEC to address outstanding comments before the board votes, prompting Nicosia to continue the matter despite arguing most of the engineer's comments fall under the Conservation Commission's jurisdiction. One abutter, Tom Kirk of 30 Kendall Road, raised drainage and parking concerns; Nicosia said stormwater would be addressed at the Conservation Commission and confirmed that parking signage and crosswalk markings are already part of the approved plan set. In a separate discussion, board members identified priority changes to subdivision regulations — including higher bonding amounts with annual cost-escalation language, mandatory binder repaving after one year, and quarterly developer progress updates — and asked Town Counsel to draft boilerplate condition language, noting the subdivision rules have not been substantially revised in approximately 16 years.
